产假是指在职女性产期前后的休假待遇。产假时间一般从分娩前半个月至产后两个半月，晚婚晚育者可前后延长至四个月，女职工生育应享受不少于九十八天的产假。职业女性在休产假期间，用人单位不得降低其工资、辞退或者以其他形式解除劳动合同。 现在我国正式实施的产假标准依据2012年4月18日国务院常务会议审议并原则通过的《女职工劳动保护特别规定（草案）》。草案将女职工生育享受的产假由90天延长至98天，并规范了相关待遇。 2021年5月31日，中共中央政治局召开会议审议《关于优化生育政策促进人口长期均衡发展的决定》，提出实施一对夫妻可以生育三个子女政策及配套支持措施。7月20日，关于三孩生育手续等问题，国家卫生健康委相关司局作出权威答复，女方生育三孩享受国家法定产假98天（针对全国性政策）。
